I understand I am purchasing a {membership_title} for {membership_duration} of unlimited access to the Facility with the one time cost of {membership_fees}.  For a total of {membership_total_amount}. 

In consideration of being allowed to participate in any way in the weight training activities and programs at Iron Athlete ("Facility") and to use its fitness equipment and facilities, I, the undersigned, acknowledge, appreciate, and agree to the following conditions:

1. Acknowledgment of Risk: I understand and acknowledge that the use of exercise and training equipment, and participation in weight training activities, inherently involves risks that may lead to physical injury, including but not limited to, muscle strains, ligament sprains, bruises, broken bones, cardiovascular complications, and possibly death. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for my participation and use of any equipment.
2. Physical Condition and No Medical Advice: I affirm that I am in good physical condition, do not suffer from any disability or condition that would prevent or limit my participation in weight training activities, and have not been advised against participation by a qualified health professional. I acknowledge that Iron Athlete and its staff are not providing medical advice related to my physical condition or abilities.
3. Limited Staffing Acknowledgment: I acknowledge that Iron Athlete operates with limited staffing, especially during certain hours of the day or night. I understand that this means there may be no staff present to assist in the proper use of equipment or in the event of an emergency. I accept the increased risk that comes with using the facility during these times.
4. Waiver and Release: I hereby release, waive, discharge, and covenant not to sue SZ Performance Development, LLC, dba Iron Athlete, its owners, directors, officers, employees, volunteers, agents, and other participants (collectively, "Releasees") from any and all liability to me, my personal representatives, assigned heirs, and next of kin for any loss or damages, and any claim or demands therefore on account of injury to my person or property or resulting in my death, arising out of or related to my use of or presence upon the facilities of Iron Athlete, whether caused by the negligence of Releasees or otherwise, to the fullest extent permitted by law.
5. Indemnification: I agree to indemnify and hold harmless Releasees from any loss, liability, damage, or costs they may incur due to my presence in or upon the area and/or use of the facility, whether caused by my negligence or otherwise.
6. Severability: I agree that this Waiver and Release is intended to be as broad and inclusive as permitted by the laws of the jurisdiction in which the Facility is located and that if any portion hereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

I have read this release of liability and assumption of risk agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
